Brief of PIL against UBER for Grievance Redressal Mechanism
Quick Brief on the #Public Interest Litigation (PIL) filed before the Hon’ble Bombay High Court addressing the lack of consumer grievance redressal mechanism to resolve complaints raised by the customers against #Uber India in respect to Article 14, 19, 226, 227 of the #Constitution Of India, Motor Vehicles Act, and Motor Vehicle Aggregators Guidelines, 2020. The two-Judge Bench was headed by Justice Dipankar Datta and Justice GS Kulkarni.
1. Plea against Uber India filed in the Hon’ble #Bombay High Court accusing lack of grievance redressal mechanism. Many Customers face difficulty in raising issues related to booking of cab service.
2. The Petitioner faced hurdles while booking a cab from the alleged company Uber, subsequently facing poor ride experience and payment of money. Uber’s mobile application does not allow to complaint the problems in a satisfactory manner.
3. The Court wanted to hear the State’s directions in handling the Uber company with respect to the #Guidelines of 2020.
4. Petitioner points that Details to contact the cab service company were not easily available. He further stated that the company was not complying with the statutory obligations and was violating the terms and conditions stated in the Advisory for licensing, compliance and liability of On-demand Information Technology based Transportation Aggregator (Advisory).
5. There are no grievance officers assigned in the company to address the customers’ problems. No valid telephone number and Email address are provided to the customers leaving them helpless and without giving a proper solution.
6. Public at large should be given the liberty to address their grievances, and only by doing that the rights of the customers will remain and no one shall be deprived of that right.
7. Following directions were given by the Hon’ble Bombay High Court:
a) Directed the Union as well as the State Government to adhere to the guidelines stated in the #Motor Vehicle Aggregators Guidelines, 2020.
b) Directed the #State Government to order the cab service company Uber to add their complete details in the mobile application, and resolve the issues of the customers as soon as possible giving a stipulated time.
c) Ordered Uber to adhere to the statutory obligations, and terms and conditions in Advisory for licensing, compliance and liability of Ondemand Information Technology based Transportation Aggregator [Taxis (4+1)].
